ELEVATE FITNESS TERMS OF SERVICE
Please read these Terms of Service (“Agreement” or “Terms”) carefully before accessing or using the website, online services, mobile services, booking platform, facilities, classes, programs, or other services offered by Elevate Fitness Bellevue LLC, doing business as Elevate Fitness (“Elevate Fitness,” “we,” “us,” or “our”).
By accessing or using our website, creating an account, purchasing a membership or package, booking or attending a class or training session, participating in an event or program, or otherwise using Elevate Fitness services (collectively, the “Services”), you agree to be bound by these Terms and all applicable laws and regulations.
If you do not agree to these Terms, you should discontinue use of the Services.
If you wish to become a member of Elevate Fitness, you must review and accept these Terms as part of the registration and/or membership process.
PERSONAL ACCOUNTS
Certain Services may require you to create an account through Elevate Fitness or one of our third-party booking or membership platforms.
You agree to provide accurate, current, and complete information when creating your account and to keep that information updated.
You may not use another person's account without permission. You are responsible for maintaining the confidentiality of your account credentials and password and for all activity occurring through your account.
You agree to notify Elevate Fitness promptly if you become aware of any unauthorized use of your account or other security breach.
PERSONAL BELONGINGS
Elevate Fitness is not responsible for the loss, theft, damage, or safekeeping of personal belongings brought into or left at our facility.
By entering the facility, you acknowledge and assume the risk associated with bringing personal property onto the premises. Members and guests are encouraged to secure their belongings and avoid bringing unnecessary valuables into the facility.
REFUND POLICY
Memberships, Packages, Credits & Trials
Unless otherwise expressly stated in a specific membership or purchase agreement, all memberships, session packages, class credits, promotional offers, and trials are non-refundable.
Membership cancellation, suspension, expiration, and other membership-specific terms may be governed by the applicable membership agreement or purchase terms accepted at the time of enrollment.
Retail Merchandise
Unused merchandise may be returned for a full refund within 7 days of purchase.
Eligible unused merchandise returned within 30 days of purchase may receive store credit.
ASSUMPTION OF RISK & LIMITATION OF LIABILITY
By purchasing a membership or package, attending a class or training session, participating in an event, activity, open gym session, or other program, or using Elevate Fitness facilities or equipment, you acknowledge that physical exercise and fitness activities involve inherent risks.
These risks may include, but are not limited to, muscle strains, sprains, falls, equipment-related injuries, abnormal blood pressure, dizziness, fainting, cardiovascular events, serious bodily injury, and, in rare circumstances, death.
You voluntarily choose to participate in physical exercise and understand that you are responsible for determining whether you are physically capable of participating.
Elevate Fitness strongly recommends consulting with a qualified physician or healthcare provider before beginning a new exercise program, particularly if you have an existing medical condition, injury, physical limitation, or other health concern.
By participating in Elevate Fitness Services, you acknowledge the strenuous nature of physical exercise and voluntarily assume the risks associated with participation.
To the fullest extent permitted by applicable law, you agree to release and hold harmless Elevate Fitness Bellevue LLC d/b/a Elevate Fitness, together with its owners, employees, coaches, instructors, contractors, representatives, and agents, from claims, liabilities, costs, or damages arising from the ordinary and inherent risks associated with your voluntary participation in Elevate Fitness activities or use of its facilities and equipment.
Nothing in these Terms is intended to waive or limit any right or liability that cannot legally be waived or limited under applicable law.
MINORS
No individual under the age of 13 may independently participate in Elevate Fitness Services.
Participants ages 13 through 17 must have the involvement and authorization of a parent or legal guardian and may be subject to additional supervision requirements established by Elevate Fitness.
A parent or legal guardian accepting these Terms on behalf of a minor acknowledges the risks associated with the minor's participation and agrees to comply with all applicable Elevate Fitness policies.
WEBSITE CONTENT & INTELLECTUAL PROPERTY
Unless otherwise indicated, content made available through Elevate Fitness websites, digital platforms, and Services—including text, graphics, logos, photographs, videos, programming materials, workout content, designs, trademarks, service marks, and other materials (“Content”)—is owned by or licensed to Elevate Fitness and is protected by applicable intellectual property laws.
Content is provided for personal, non-commercial use only.
You may not copy, reproduce, distribute, transmit, sell, license, publicly display, commercially exploit, or otherwise use Elevate Fitness Content without prior written authorization from Elevate Fitness or the applicable rights holder.
You also agree not to circumvent, disable, interfere with, or attempt to bypass security features or restrictions associated with our websites, platforms, Content, or Services.
Any comments, suggestions, ideas, or other feedback voluntarily provided to Elevate Fitness regarding our Services may be used by Elevate Fitness without restriction or compensation, provided such use complies with applicable privacy laws.
MOBILE & ELECTRONIC SERVICES
Elevate Fitness Services may include features accessible through a mobile phone, website, or third-party application, including the ability to:
Purchase memberships, packages, or services;
Reserve or cancel classes and appointments;
Manage your membership or account;
Receive service-related communications;
Access facility or membership features; and
Receive SMS, MMS, email, push notifications, or other electronic communications.
Elevate Fitness does not separately charge for standard mobile access to these Services; however, your wireless carrier, internet provider, or other service provider may charge messaging, data, or other fees.
Not all features may be available on all devices or through all carriers.
Where required by applicable law, marketing communications will be sent only with appropriate consent, and you may opt out of marketing communications using the methods provided in those communications. Certain transactional or service-related communications may still be necessary to administer your account, purchases, reservations, or membership.
TERMINATION OF ACCESS
Elevate Fitness reserves the right to suspend or terminate access to its website, digital Services, facility, membership, or programs when reasonably necessary, including for violations of these Terms, membership agreements, facility rules, inappropriate conduct, nonpayment, safety concerns, or misuse of Elevate Fitness Services.
Termination may result in the loss of access to information or Services associated with your account.
Any provisions of these Terms that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, assumption of risk, limitation of liability, dispute resolution, and other accrued rights or obligations.
THIRD-PARTY SERVICES
Elevate Fitness may use or provide links to third-party websites, applications, payment processors, membership management systems, booking platforms, or other services.
These third-party services are not necessarily owned or controlled by Elevate Fitness.
Elevate Fitness is not responsible for the content, privacy policies, terms, availability, security, or practices of independent third-party services. Your use of a third-party service may be subject to that provider's separate terms and privacy policies.
We encourage you to review the applicable terms and privacy policies when using third-party services.
GOVERNING LAW
These Terms and any additional rules, policies, or agreements incorporated into them shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict-of-law principles.
CHANGES TO THESE TERMS
Elevate Fitness reserves the right to modify or replace these Terms from time to time.
Updated Terms may be posted through our website, membership platform, or other appropriate means. Where required by law, additional notice may be provided.
Your continued use of Elevate Fitness Services following the effective date of revised Terms constitutes acceptance of those revised Terms to the extent permitted by applicable law.
We encourage you to review these Terms periodically.
If you do not agree to revised Terms, you should discontinue use of the applicable Services.
ELIGIBILITY
Use of Elevate Fitness Services is void where prohibited by law.
Individuals must generally be at least 13 years old to register for or participate in Elevate Fitness Services.
Individuals between the ages of 13 and 17 may participate only with the involvement and authorization of a parent or legal guardian and subject to Elevate Fitness policies regarding minors.
By registering for or using Elevate Fitness Services, you represent that you meet the applicable eligibility requirements.
MEMBERSHIP TERM
These Terms remain in effect while you use Elevate Fitness Services or maintain an active account or membership.
Membership cancellation requirements, notice periods, commitments, freezes, renewals, and other membership-specific conditions are governed by the membership agreement and/or purchase terms accepted when the membership is purchased.
Elevate Fitness may suspend or terminate a membership for material violations of these Terms, an applicable membership agreement, facility policies, nonpayment, unsafe behavior, or other grounds permitted by law.
Certain provisions of these Terms will continue to apply after termination where appropriate.
FEES
You acknowledge that Elevate Fitness charges fees for memberships, classes, personal training, packages, programs, merchandise, and/or other Services.
Elevate Fitness reserves the right to modify pricing for future purchases and, where permitted by the applicable membership agreement and law, recurring Services.
Any applicable taxes, processing fees, or service fees will be disclosed as required in connection with the transaction.
Service Fees
Payments for memberships, session packages, and other purchases may include a service or processing fee calculated and collected through Recess, our membership and booking software provider.
Where applicable, the exact fee will be disclosed during the purchase process before the transaction is completed and/or reflected on your receipt.
PASSWORD & ACCOUNT SECURITY
You are responsible for maintaining the confidentiality of your password and other account credentials.
You agree not to use another member's account, username, or password without authorization or disclose your credentials to unauthorized third parties.
You agree to promptly notify Elevate Fitness if you suspect unauthorized access to your account.
You are responsible for activity conducted through your account to the extent permitted by applicable law.
ENTIRE AGREEMENT; NO WAIVER
These Terms, together with our Privacy Policy, applicable membership or purchase agreements, waivers, facility policies, and other legal notices or agreements accepted by you, constitute the agreement between you and Elevate Fitness concerning the applicable Services.
If any provision of these Terms is determined to be invalid or unenforceable by a court or other tribunal of competent jurisdiction, the remaining provisions shall continue in full force and effect to the fullest extent permitted by law.
Elevate Fitness's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
DISPUTE RESOLUTION & ARBITRATION
To the extent permitted by applicable law, you and Elevate Fitness Bellevue LLC d/b/a Elevate Fitness agree that disputes or claims arising from or relating to these Terms, the website, membership, or Elevate Fitness Services may be resolved through final and binding arbitration where required by an applicable agreement between the parties.
Nothing in this provision prevents either party from seeking injunctive or other appropriate equitable relief when necessary to protect intellectual property rights, confidential information, or other rights for which monetary damages would not provide an adequate remedy.
Any arbitration provision shall be interpreted and enforced in accordance with applicable federal and Washington law.
